HOUSTON TX Dec 14 2016 – A security guard has filed a class-action lawsuit against a Houston company over allegations that he was not properly compensated for all hours worked.
Earl Davis Jr. filed a complaint on behalf of himself and all others similarly situated on Nov. 14 in the Houston Division of the Southern District of Texas against against Ricky Lee Flakes, doing business as Champion Security Agency, alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that during his employment with defendant, he worked approximately 70 to 80 hours per week without receiving overtime compensation. The plaintiff holds Flakes responsible because the defendant allegedly failed to pay the statutory overtime for all hours worked in excess of 40 per week, failed to compensate him at the minimum wage rate for off-the-clock work and failed to keep payroll and time records.
The plaintiff requests a trial by jury and seeks an order for defendant to pay him and all others similarly situated the difference between what they should have been paid for overtime hours, attorney’s fees and costs, post-judgment interest and all other equitable or injunctive relief.
